Tenure Charges Filed Against Mullica Teacher

Mullica kindergarten teacher may be fired after finding students naked

MULLICA TOWNSHIP — Residents and teachers in this rural community are rallying around a veteran teacher who may lose her job after she found two of her kindergarten students naked in her classroom bathroom and promptly reported it to a principal.
Superintendent Brenda Harring-Marro has filed tenure charges against the teacher, Kelly Mascio, of Mullica Township, said Mullica Township Education Association President Barbara Rheault.


“Our main concern is that the administration has completely forgone all traditional disciplinary avenues available in handling the incident,” said Rheault, who is also a township committeewoman. “The administration has selected a disciplinary route that has resulted in enormous emotional and professional turmoil, and has strained the confidence and trust of school staff, parents and community members.”

Mascio, who has been teaching for more than 15 years and has children in Mullica Township schools, has been suspended with pay since a Sept. 30 incident in her classroom. According to a police report, two 5-year-olds — a boy and girl — went into the in-classroom bathroom together. Mascio found them naked in the restroom, and they told her they were “having sex,” according to the report.
Mascio immediately reported the incident to Principal Matthew Mazzoni, who in turn advised the Police Department and the state Department of Youth and Family Services, according to the police report. Mascio was immediately suspended.

The police closed the case, finding no reason to pursue criminal charges, according to the report.
The Board of Education met Wednesday night in executive session to determine whether to certify the charges, which would bring the issue before a state arbitrator to decide if Mascio can be fired.
About 200 people came out in Mascio’s support, but the board refused to tell the public whether it had certified the complaint, Rheault said.
She added that Sept. 30 was a highly unusual day, and children were moving in and out of Mascio’s classroom for MAPS benchmark testing.

Mascio declined comment, as did Board of Education Solicitor Will Donio.
Carol Kienzle, of Egg Harbor City, said her nephew’s children had Mascio as a second-grade teacher, and this was Mascio’s first year teaching kindergarten. Kienzle said Mascio is a much beloved teacher and has the support of many parents in the community.

Not only has the new administration "strained the confidence & trust of school staff, parents & community members", it has turned what was once described as a "gem" into a common stone. The kids are not performing at the same level they did years ago. Our wonderful teachers are carrying an enormous burden of stress and pressure. The joy of teaching is being lost along with good programs and common sense procedures. I'm a parent who is worried about how all the changes and the atmosphere at the school will affect my children.

This story is just UNBELIEVABLE. Teacher does the CORRECT thing and gets suspended immediately and this happened back on September 30th, 2013 and it is now Feb. 22, 2014 and we are just finding out about this...

This whole affair is surely going to cost the taxpayers of Mullica Township BIG money and our tax rate will go up. So don't blame the Mayor for this one.

The people of Mullica should pack the meeting demand the teacher get her job back with all backpay and expenses incurred and the IMMEDIATE termination ofSuperintendent Brenda Harring-Marro and anyone else who had a hand is this senseless decision to fire someone for doing their job.

Such idiots.....

I can't even imagine what Ms. Mascio has been mentally going through the last 5 months! I hope she does get a good lawyer. I've loss respect for our board and the administration for not handling this matter in a timely,appropriate manner.

Don't blame the Mayor? . We'll guess what he is the CEO of this company called Mullica Twp. and I think you said it's going to cost the taxpayers money. The mayor is supposed to be in charge of all aspects of the township which includes the education system.

Quite a few of the members of the Board were pushed on and supported by the Mayor and the Repub. Club, just like he stacked all the other Dept.'s with his people. Just as secretive,too.
I hope child services investigated these children's homes thoughly. One or both are being exposed to adult activities or maybe even being abused.

I'm sorry but if the police came and told me that my 5 yr old baby girl was found naked in a bathroom "having sex" with a little boy because somebody at the school wasn't supervising the kids, I would be the one calling my lawyer.

Believe me if this is the case and the Mayor and ALL committee people are in charge or as you put it the CEO of Mullica Township, it will be addressed at the next township meeting for a number of reasons.

First and foremost, why was this kept quite for so long? One former committee person had posted on Facebook to come out to the school board meeting, but never mentioned any of this. Perhaps if that person did, more people would have shown up, I know I would and I will be at the next one in support of the teacher, but more importantly MY TAX DOLLARS and TAXES.

Secondly, why in the world would you suspend a teacher for 5 plus months with pay only to have to replace her and pay double if not more. She should have never been suspended in the first place for doing her job.

Again the Taxpayers regardless of Democrat or Republican are taking it on the chin and it needs to stop. What needs to be done is to get to the bottom of it all and find out who the decision makers were in all of this and send them packing.

I understand how you feel. I was lucky to have my kids finish school while it was still the "gem". I've heard that things are different now. All the teachers are being switched to different classes,state testing pressures,low moral,different lesson plans,programs dropped, etc.

This was Mrs. Mascio's first few weeks in a class of 5 yr olds and kids were going in and out for testing. I understand how one minute of distraction in a room of little ones can have disastrous results but I feel the administration is way out of line suggesting dismissal.
It's even stranger that they put Mrs. Mascio on paid leave for the last 5 months while they figured out what to do. They are showing incompetency in every aspect of this case.
I do believe the parents will seek compensation.

I just read over 40 comments under the Press article at the link.
John Paff stated "If the Board did agree to certify the charges,it needed to take the formal certification vote in public, or at least ratify that decision in public.
Burnett V Gloucester, 409 NJ Super. 219,238 ( The OPMA is violated when formal action is taken in the closed session and never ratified or even discussed in a public session.)
If this is true,the board did not ratify the complaint or else they are in violation of the law.

I would like to know why the Board refused to give any answer to 200 people. A simple "No, that matter is still under investigation and discussion" would have been better than a refusal to answer.
The Board's attitude shows total disrespect for the citizens of Mullica. Such arrogance by people who were elected by the taxpayers is sickening.
This is why we need reporters, cameras, watchdogs at both the school and Town Hall. I'm soooo tired of back room secret meetings and decisions made that the public finds out about at the last minute.

I would bet a lot of money that the school administration is really angry that this matter was reported. Mayor Brown also has shown a distaste for reporters.

I'm going on what I'm reading in the paper and this does not warrant dismissal. There are other disciplinary procedures that should have been addressed first.
The way the Administration and the Board of Ed is handling this case makes them look secretive,arrogant, incompetent,unprofessional,and vengeful toward all the teachers.
I heard a long time ago that the Administration and staff were having a tense relationship.

The main thing everyone seems to be missing here is that she was negligent in doing her job. Two children not seen in classroom for the period of time it would take them to get undressed together in a bathroom that is located in the classroom and you don't notice they are both missing? Negligence. My question is what took so long for the BOE to address this?

The teacher's crime is not bringing her other six pair of eyes to class with her.The little imps took advantage of a busy moment in my opinion.
The teacher reported the incident immediately and now is being punished most severely.
The Board's action is telling all the other teachers to ignore all types of bad behavior or cover it up or else your job is on the line.

This behavior in 5yr olds is a sign that they could have been sexually abused or are being exposed to adult behavior or media.
If teachers are afraid to report things that happen in their classes, the children will be left without help or intervention.

As to why this has dragged on for 5 months, I would suggest that the answer is the total incompetency of the board and administration to address problems correctly,cost efficiently,and in a timely manner. They are the negligent parties in this case.

Her job is to teach and have a handle on her class. Ms. Mascio may be a wonderful person, but as a teacher, if you don't realize two 5 year old children aren't in the classroom, then you aren't doing your job correctly. They could have walked out if the classroom and left without her noticing, then what? Stop focusing on the "sex" part and look at the big picture. Of course the teachers will rally around her, she's one of their own. Why the board took so long, I don't know. Tenure doesn't mean you become lazy and complacent. You still have a job to do and she was negligent in hers. Had she not had tenure, they would have gotten rid of her immediately.

Why are we just finding this out. Ever since Mr. Goldberg left there has been no unity. The teachers are like aunts and uncles to our children. To us parents they're like brothers and sisters. I hope they know that if this teacher gets fired none of them will have a chance of getting reelected. Then maybe they will learn what unity is all about. If something's not broke why try to fix it. Taking science teachers to teach history? Take a coputer teacher to teach history then hire a new coputer teacher? Teachers once wanted to come here now they can't wait to leave. WAKE UP BOARD OF ED!

1) The Middle School Principal filed and failed to correct (in 5 months)a false report to the Police.
2) one of these children did this in PK and Kelly Mascio wasn't told
3) Her aide was unavailable as she ferried the kids to and from MAPS testing that day. Why didn't Administration supply a substitue aide for this so the teacher of 22 had help to keep an eye on the children
4)The PK teacher is still employed
5)Firing is extreme when she notified the School Psychologist, J. Leith
6)Kelly was writing her incident report, supervising children right up to Bustime, why if she was 'unfit to supervise?"
7)PK teacher told administration and didn't tell Kelly Mascio? Can you say "SET UP?"
8) Mazzoni lied and the Superintendent hid it for 5 months; that seems to warrant being removed from their positions
Get Mr Dugan and Mr Goldberg back until a new search can be put into place.
There are more administrators in the school than there ever have been while Egg Harbor City combined their Superintendent and Principal when their Superintendent left. So we pay more and get less.
There's something rotten in the way Mascio has been treated

If you have ever had a 5 year old did you ever say to yourself "I just took my eyes off him/her for a minute and they....." Grocery store, shopping, yard, in the house.
Some natural curiosity is normal. One of the children has done this repeatedly and they were "overlooked" for this behavior has been done before. Seems to me that Mrs Mascio should have had help as the recommended ratio is one adult to 10 children, she was set up by adminisitration.
No new hires have been from Mullica and that is deliberate. Don't want Mullica to know too much what's going on inside the school. The gossip is unfavorable to the control of the Administration.

Are you sure that there were 22 kids in the class? The State code only allows 21 kids to a class in Mullica because of the free lunch program.

The legal charges against Kelly stated there were 21 children in the class. If you are correct in the 22 number,the administration has lied on the legal papers. Also removal of the aide and sending her to substitute in another class was a violation of law. Kelly was alone at the end of the school day packing up the kids

I agree that the teachers from Mullica are being targeted and outsiders are being hired.
What is wrong with our school board????

.....ummmmm, you people in Mullica township are totally nuts! Has anyone even considered why two five years olds would KNOW that you remove your clothes and have sex? Have the parents been investigated, like you are willfully doing to this teacher?

I do not live in this township, but it's surely sounds suspect to me that there is no mention of anyone investigating the parents of these children as to what they have been exposed to? Of course.....it's seems Administration blames the teacher (scapegoat) as an easy way out. I am sure that the powers to be....are guiding the board to escalate this situation, so that the parents feel vindicated. Board of Ed. you have a Superintendent that could cost you big time. Support her in this....and you will have continuous troubles. And.....the brainiacs on this blog who have saidi that the teacher should never have a moment of not knowing where each child is.....every second of the day, is more crazy than the situation itself! That is why children go to school at an age whereby they can independently operate to some degree. To expect a teacher to know where twenty two children are evey second of the day is ridiculous. Do you parents know where your children are within your home every minute of the day? Parents....can you actually say you NEVER have had one moment of not knowing where your kids are? Although I am from another town and don't know all the particulars....I would speculate that you have a Superintendent that will cause you more problems then she is worth. Really, come on.....state of New Jersey, get rid of them all, Admininstration and Board of Ed. and revamp this school. And, kudos to the one person on your board, according to the newspaper that voted Ms. Mascio not be fired. Certainly, for fifteen years this teacher must have been doing something right. Does that....warrant this?

I've been following this story from the beginning and reading all the comments from the different Press articles and here.I was shocked when I read the first article about the kids being naked and having sex.
To find out it was a false report by the principal that was never corrected and what is really going on with this administration,made me really angry.
I'm sure Mrs Mascio will returned to her classroom but it can't stop there.
A whole team from the state should come in and investigate EVERYTHING that has occurred in the school since Marro took over including her qualifications to even hold this position.
It seems all the children are having their education compromised by Marro's self-serving edicts. and destructive changes.
The state should confidentially interview every teacher to see if other state codes have been violated such as removal of aides, uncertified teachers,subs with no curriculums or guidance,cover-ups of other incidents,lack of parental notifications,harassment incidences,etc.
I sincerely hope that the teacher's union presses for an investigation now because things will be worse later.

Has anyone considered this is a classic case of the overload put upon teachers? For you who have judged Mrs. Morro harshly, you are doing so with the thought that she is working within a reasonable workload. We are a society that makes sure that our children are free of bullying. Yet, this is the new adapted behavior toward our educators. Administrators now have free reign to overload a teacher to their hearts desires. If they fail...they will be cited with failure. Sure reeks of power by an Administrator to set up, and target who they simply do not like. Most of these Administrators have never spent one full day teaching a primary class. Yet, they are given the power of judgment, and expertise in this venue. Tomorrow, I hope when you critics of this teacher arrive at your prospective jobs, are told by your supervisor that your workload has doubled, and there is absolutely no tolerance for human error. And, if the supervisor so chooses, you might be required to do the aforementioned while being intimidated. You, who are judging Mrs. Morro harshly, would for sure have a change of heart if you were the victim of being targeted at your place of employment. You would probably scream the loudest! Please rethink your harsh position.

I agree with your post but you have the names confused. Kelly Mascio is the teacher that the majority of the town is supporting. Marro or "Morro" is the Administrator putting all the pressure on the teachers.

Could the administrator of this site possibly correct Morro, to Mascio in the 10:01 post today? Don't really know what to do but maybe take it down. I am in no way in support of this Administrator. I heard we are paying Marro over $134,000 a year.That's over $11,000 a month of our tax dollars going toward the destruction of our school. Our property values will drop like a rock without a good school as a prime incentive to move here.The Board HAS to fire Marro if we are to get back on track.

FYI - From the Press of AC (following the article about the vote of no confidence......) Kathy Moore : referring to Dr. Marro "You are talking about a so-called leader who condoned and hid from the Board an employee illegally collecting unemployment. Had the Board paid attention to those facts presented Brenda would have been gone 2 years ago! This cost the State and Mullica taxpayers money but was swept under the rug. She is corrupt and SHE needs to go now!!"

Dr Harring Marro only makes $134,000 for being Superintendent of Mullica but she is also the Superintendent for Greenbank in Burlington County through a sharing agreement for an additional $______,_______ per year. Plus the MS Principal (who filed the false Police Report which will be crucial to the awards in the teacher's defamation lawsuit) gets a healthy "stipend",too. Cozy arrangement, for trying to railroad a teacher.

The Principal involved has had many run-ins with excellent teachers and they have retired (when able) some choosing to leave without benefits rather than stay and be "stressed out" into a heart attack over his subjective evaluation of their job ratings... he's the person who filed the "false report" in the Press that was there for 5 months!

That will up the amount awarded to Kelly but I am sure she would rather have not lived through this experience.Poor Kelly lived under that cloud for 5 months and now it comes out that it was false.

AND Still the BOE votes to proceed to get her teaching certificate and ensure she never teaches again. He was Principal when there was a sexual incident on a Bus and he wasn't fired.

Neither the Principal or the Superintendent corrected that and allowed her to be pilloried in the Press for this whole time! What a lawsuit for Kelly as professional libel is so much worse (read expensive) when she files against them and our Township.

That isn't applicable with tenure charges. Tenure charges under no circumstances will be in a public session.

Let the teacher have her job back. This issue goes beyond the classroom. When do 5 year olds even KNOW about sex??? Question the parents and other family members. The children learned this at home. Keeping track of about twenty 5 year olds is not an easy job.

Speaking of- Brenda's new hires were introduced at a School board meeting as her "RockStars"
She asked the school board if they wanted her to hire Mullica Residents or Qualified teachers. That implies that teachers of Mullica are not qualified. What a slap in the face to the very veterans who made our school so successful. I live in this community - I want my kids to have qualified teachers as any normal person would. However, the Mullica Residents- even the student teachers who were interviewed had more credentials and experience than her RockStar hires. So I'm just wondering what standard makes you a RockStar teacher?!

Poor Matt Mazzoni was a tool. We were angry at him and blamed him for that false police report. Once word got out what he did it spread like wild fire and we were furious. However- now that the arbitrators report is public, if you read all 27 pages, you will learn plenty of how badly Brenda Marro lied and misled. You'll also see SHE was the one who notified the police and made those false statements. Mazzoni did as she directed while she notified Mullica PD. IT WAS ALL BRENDA MARRO. More reasons to lose faith in the leader of our school district. And why didn't Matt deny or defend himself. He took the fall for her. Why
