LAWYER TELLS MULLICA TO "FUHGETABOUTIT"??

Once again, Mullica is in the news in The Press of Atlantic City in only what can be described as another "HUH????" article. Kennedy's lawyer has decided to waive his fees in "very difficult economic times" after Kennedy threatened to sue the township for not paying the balance of his legal bills. I wonder if other attorney's across the county are doing the same? This wasn't a courtesy to the Township, this was Kennedy's personal bill, so the confusion has set in. This is one of the most contradictory articles I've read lately in the Press, Kennedy's lawyer Feldman decided to waive the fees he's owed by KENNEDY citing "very difficult economic times". Feldman e-mailed a letter to The Press of Atlantic City (again, why to them????) and stated "I believe it would be inappropriate to impose a financial obligation on the citizens of the Township of Mullica to resolve this outstanding bill. The burdens facing taxpayers together with the cutback in municipal budgets, many times resulting in layoffs, warrant another approach," Feldman said in a letter dated Feb. 3, which he e-mailed to The Press of Atlantic City on Thursday. "The substantial expense in litigating this issue could be better used to provide services to the employees and citizens of Mullica Township."

Kennedy planned to sue to Township and then Feldman would have had to sue Kennedy for the money. Did Feldman not have a contract with Kennedy? All lawyers, require a deposit and most a contract signed and Feldman has been around a long time and I am sure he had a contract with Kennedy. Maybe Kennedy should have been like anyone else and PAID HIS OWN LEGAL BILL. I'm betting Lou Vitale paid his attorney fees for the bogus cross-complaint Kennedy slapped on him.

And yes, once again, the world revolves around Janet Forman in her statement: "Absolutely, the change in voting was for a personal reason," Forman said of Graebener's decision. "There was nothing different from December to January, other than me being mayor." Note to Janet: IT'S NOT ALWAYS ABOUT YOU. I doubt after reading the judge’s final summation Graebener would have voted to pay the balance had he himself been named mayor.

OWN UP AND BE A MAN BILL, PAY YOUR OWN LEGAL BILL FOR YOUR OWN ACTIONS. The Township shouldn’t have had to pay it nor should Feldman have waived it for Mr. Kennedy.

I agree with Janet Forman. Feldman did deserve his money.
Since Kennedy hired the man he should have paid him.
I agree with Bernard Graebener that Kennedy could still pay the lawyer if he wanted to.
Feldman probably knew a suit against the town would go no where and didn't want all this bad publicity because of $1,500.
This was the best way to keep Kennedy from dragging his name into this mess again.
It's too bad that Kennedy refuses to pay for his own mistakes.

This whole vote was about "reimbursing " Kennedy for his legal fees.
That means to pay back or refund the money to Kennedy. Feldman should have been paid in full 6 months ago.
Did the town sign a contract with Feldman? Did someone tell him that the town would pay the bill?
Isn't he the attorney that Forman uses in criminal matters?
It's very rare for an attorney to waive their fees and even rarer to e-mail the Press that they are doing so.
It's obvious that this man did not want Kennedy on the stand again and the only way to stop him would be to drop the bill.

How nice it would have been to hear those intelligent words from our own Ex-Mayor and present committeeman.
Mr. Kennedy has proven time and time again that the citizens of Mullica are the least of his concerns. He caused his own problems by his bad behavior and the taxpayers should not be expected to fund his stupidity.

His statement "Damn right, I'm going to sue" shows how little he cared about the people of Mullica.
That also can be said of Forman and Chasey who backed giving away the people's money in a case like this.

I don't understand why Feldman e-mailed the Press 10 days ago.
Was the Town informed of this?
Was Kennedy informed of this.
Was it mentioned at the last town meeting?
Why was this news held for 10 days?

Forman was a client of Feldmans' plus she's the Mayor. I think out of courtesy he would have spoken to her first. She probably called him on Jan. 27th. to tell him about the vote.
Maybe the reporter held the story to give the committee a chance to break the news at the Feb. 10 meeting. Which they didn't.
Maybe Feldman wanted it out in the public because he knew certain people were not announcing the news and were playing games.
Something is not right here and I'm sure discussions were held with certain town officials before the e-mail was sent.

What the hell is Kennedy talking about in the last line. ""There's no doubt in my mind , that if he had sued,he would have won".
Feldman wasn't going to sue the town, Kennedy was.
If Feldman was going to sue anybody,it would have been Kennedy he sued. I'm sure he would have won that and put a lein on Kennedy for the money.

Kennedy apparently does not seem to understand that just because he was mayor, the title alone does not protect him from being financially responsible in all instances, no matter what the circumstances.

Is that some kind of subliminal clue that this story involves Forman much more than expressed?

The Press said that the letter was dated Feb. 3 but didn't say who it was addressed to.
The letter was e-mailed yesterday to the Press. Who had the letter for 10 days?

That was my initial feeling too when I saw the Press article today. The photo of Forman next to Kennedy seemed say that she was as much part of this story as he was.

Sounds like Forman contacted Feldman about "Poor Bill" and concocted some deal where Feldman would send an email to the Press about it, again no one knows why Feldman would care unless he's doing a favor to his good friend and former clients, the Formans.

Bill doesn't even know what he's talking about, Feldman couldn't have sued the town himself it was Bill's bill-doh.

Bill wouldn't have sued anyway because he couldn't have used Feldman, he's a criminal attorney, but would have had to find an attorney who specializes in suing municipalities and since Bill couldn't even pay Feldman $1,500, how was he going to pay another lawyer to sue to get the money for Feldman? Bill should be humiliated to have this article in the paper. It's not about how "he saved the day and kept the township from being sued", it's how he was once again used as a political pawn by Janet, to make herself look good and all it did was make Bill look like the ignorant, cheap, broke fool that he is.

Economic climate? Indemnification? Kennedy doesn't even know what these words mean.

"It was a nice gesture, but it should never have had to happen,"said Kennedy. So PAY FELDMAN THE MONEY YOU OWE HIM FOR DEFENDING YOU. It doesn't have to happen if you do the right thing, but that's not in your vocabulary. Think of the first $1,000 as a "discount coupon" and be happy you even got that. Had Graebener been able to read the judges summation before the first vote, you wouldn't have received a penny.

Forman claimed the only thing that changed from December to January was who was mayor, and it was all "political", but she's wrong-the transcript came out and that's what changed the vote. That was clearly stated in the Press of Atlantic City article on January 28, 2009.

From the article:

Committeeman Bernard Graebener, who was the swing vote after voting yes on the previous payments, said reading the recently-released court transcripts changed his opinion of Kennedy's role in the incident.

"I do not believe he was acting in a public capacity," Graebener said. "I feel bad, because I wouldn't have voted yes the first time if I had had all the information."

She knows this and is playing spin doctor once again.

4:11 poster: I think it's because she was as much a part of the story as he was; someone paid Feldman his initial $1,000 deposit Kennedy was reimbursed for. If he doesn't have $1,500, then he probably didn't have the $1,000. Think about it.

Kennedy said "Feldman saved the town additional money in legal expenses by not suing to recoup his fees".
Does he not realize that he was the one suing the town not Feldman?
All that additional money would be spent by the town against HIM.
There is something SO wrong with this guy. Everytime he opens his mouth something idiotic comes out.

Did you notice that Cathy Chasey isn't quoted in this article.
Wasn't it in the paper when this case first came out that she was quoted about a past bill like this?
She regreted her vote and said it was "ludicrous"to pay it.
The only thing political in this whole story from begining to end is Forman's and Chasey's mannipulation of Kennedy for their benefit.

The mystery to me is why Feldman e-mailed that letter to the Press 10 days after it was written.
Lawyers usually sent out their mail the day they write it. I'm wondering who received that letter and why it was kept secret.
Feldman obviously wanted a Press article about this.
This article made him look very intelligent.
Kennedy's asinine statements are some of the worst he's ever made. It's like he hasn't a clue what the whole matter is about.
The Drama Queen put on her usual sarcastic performance throwing out political lies.

So Bill is let off the hook by his and also Janet's lawyer. So why does the lawyer feel the need to advertise the fact that he will not be collecting from Bill? Why did he bring Mullica Township into the picture? The township did not owe the money, Bill did. Is the lawyer making up the loss by getting free publicity? Why is Janet placing herself in the middle of this unless she is much more involved such as having laid out the money to begin with. Bill owes her.

I think Forman just wanted to take some pot shots at the Dems.
The whole thing backfired on her too because the public was against paying tax money for this bill.
She's trying to make this into some kind of vendetta when it's just common sense that Kennedy should pay his own bill under these circumstances.

I'm disappointed that this didn't go to court. It might have settled matters. As it stands now,Forman and Chasey are always going to claim they were in the right.
If it went to court and Kennedy lost,then it would be an embarrassment to them.

Maybe Feldman knew this case could not be won and and told them.
This article did make good publicity for him and got Forman and Chasey off the hook plus Forman got to do her spinning act.

Kennedy's home free and I'll bet Forman and Chasey are whispering in his ear that they begged Feldman to do this to save Bill the bad publicity of another trial.

Heres my take. The KFC team were ready to have it go to court at taxpayers expense to embarrass Mike and Bernie on the assumption they would win. Note:money was no object here . The whole thing was to smear the 2 men and make them look stupid but only if KBill Kennedy would win. There was a lot of discussion in the past few weeks and the lawyer must have figured chances werent good that the ex Mayor was covered for his actions. If the KFC team and the lawyer lost it would have been very embarrassing (something not tolerated by Forman)so they skillfully made the lawyer seem compassionate and proclaimed "we would have won anyway" and released article to the Press. This would have worked except that the tirades of Forman in the Press under her name and various a.k,a,s reveals that she is totally consumed by her hatred towards Mr Graebener. Besides his vote and her persecution as being attacked because of politcal office(remember the DEP defense) she also doesnt like his wife.She is also a poor loser when she was told chances werent too good here. Her whhole carrer in politics is about ego and power and Mullica is being used here. Unfortunately she rides the tiger and if she leaves office shes worried about all her enemies.Mike and Bernie were right to vote "no" on the payment and the lawyer proved it.

I completely agree with the 7:29 AM poster: The Indemnification ordinance does not specifically include legal fees, it's at the discretion of the committee. Forman and Chasey (and Kennedy had he voted) said yes and Graebener and St. Amour said no. Again, from the lawyers mouth and in the ordinance AT THE DISCRETION OF COMMITTEE.

I do think Kennedy would have lost this case and the what the 7:29 AM poster said was dead on.

Hopefully the judge's summation will be released here soon and everyone can read it.

The fact that Kennedy did not have his legal bills paid by the taxpayers this time may make him a bit more circumspect in the future in what he thinks he can get away with as an elected official.

I doubt the remaining committee people will punch a citizen but at least some precedent has been set for all people elected in the future.
We have to deal with Kennedy for three more years. He got off free this time but if he keeps doing stupid things we might get lucky and have him removed from the committee. He thinks he is above the law and after reading that article, I think he's having delusions.
