Mullica Hearing Officer Appointment


TOWNSHIP OF MULLICA
RESOLUTION NO. 163-2016
APPOINTING PROPER
AUTHORITY AS A HEARING
OFFICER IN THE EVENT OF A CONFLICT PURSUANT TO N.J.S.A. 40A:14-
147 AND N.J.S.A. 40A:14-148, AND 
WHEREAS, there exists a need for Hearing Officer for the Township of Mullica and funds are available for this purpose; and
WHEREAS, N.J.S.A. 40A:14-147 and N.J.S.A. 40A:14-148, provide for appropriate authorities dealing with suspension and/or removal of members and officers, together with a Complaint and Hearing; and
WHEREAS,  from time to time a conflict may arise relative to the proper authority to hear said Complaint and conduct said Hearing pursuant to the above referenced statutes; and
WHEREAS, the Township of Mullica, in order to avoid the appearance, or, in fact, conflict regarding said proper authority has elected to appoint a proper conflict authority to conduct said hearings; and
WHEREAS, the Local Public Contracts Law (NJSA 40A:11-1 et seq.) requires that the Resolution authorizing the award of contracts for “Professional Services” without competitive bids must be publicly advertised.
NOW, THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of Mullica, County of Atlantic and State of New Jersey, that:
1.  The Township of Mullica Committee hereby appoints Steven Secare, Secare & Hensel, 16 Madison Avenue, Suite 1A, Toms River, New Jersey, 08753, as the proper conflict authority required under N.J.S.A. 40A:14-147 and 148.
2.  This contract is awarded without competitive bidding as a “Professional Service” under the provisions of the Local Public Contracts Law.
3.  A copy of this Resolution shall be published in the Hammonton Gazzette as required by law within ten days of its passage.

I thought that all resolutions were supposed to be put on the meeting agenda. This was not included on 12/13 so the public had no opportunity to ask questions or even know about this before it was passed.
