Castro Back In Court



A man who was freed after the murder indictment against him was thrown out was in court again for the same crime Monday.


Michael Castro, 34, once again pleaded not guilty in the Feb. 5, 2012, killing of 77-year-old John Kingsbury inside the Mullica Township home of the victim’s son.

Fourteen months later, Castro was charged in the case, and then arrested in Florida, where the martial arts instructor was getting ready to start a new business.
 Questions with how the case was presented to the grand jury caused the indictment to be thrown out. It took another 15 months before the case was brought back before a new grand jury.

In that time, Castro was freed, and filed a federal lawsuit against the Atlantic County Prosecutor’s Office and several of the detectives involved in the case.

He was again getting ready to start a business — this time in Pemberton, Burlington County — when he was arrested again.

He since had his bail lowered to $250,000, and is free pending trial.
The defense is awaiting evidence in the case, including an FBI report on technology, attorney Douglas Cody told the judge.

The report is connected to a cell phone, but it was unclear whether it was Castro’s phone or Kingsbury’s that was being looked at.
