Chickens Need Variance


At Tuesday night's committee meeting, Mayor Jim Brown told Jack Piper that he should apply for a variance in order to keep his chickens on his one acre property.
Piper argued that chickens are not pastured animals and the acreage for keeping chickens should not be the same as for keeping horses, cows or other grazers.
"What we're hearing so far, we don't need to change the ordinance, Brown said.  It's the only case in the township."

The committee appointed a temporary zoning officer to fill in while longtime zoning officer Tom Sandman, who told Piper he needed two acres to have chickens, recuperates from a heart attack.
Edward Toussaine, who is now the zoning officer for Winslow Township Camden County, will be paid $21 per hour in Mullica Township's part time zoning officer position.

Public Discussion:

Mr. John Adair,2070 7th Ave, stated his neighbor has continually allowed his chickens to roam his property, noting the chickens are not fenced or contained in anyway.  Mr. Adair stated the chickens have become a huge nuisance and added the municipality has sent a letter to cease and desist, but continues to ignore the laws.  Mayor stated they will follow-up on this issue.

Mr. Jack Piper, 3537 Nesco Road, asked if a resolution was determined regarding his chicken issue which he presented at the last Committee Meeting.  Mayor Brown stated this issue has been discussed and his recommendation would be for him to make an application before the Planning Board for a variance.  Mr. Hagaman concurred

Mr. John Hesington questioned the Ordinance regarding animals and stated there are chickens in his neighborhood that are accepted by all the neighbors.  Mayor stated there is an Ordinance which regulates animals, and added there was a complaint logged regarding chickens which Code enforcement addressed.

It's scary when a mayor of a pinelands town doesn't know the difference between a grazing animal and a bird.The ordinance used against Piper does not mention chickens. How is he supposed to get a variance to an ordinance that is not related to his situation?
The town needs an ordinance that addresses chickens,rabbits,etc.
I hope Piper takes this to court.
