RESPONSE: You make a valid observation. GadFly has noted in past posting that the Formans are entitled to the presumption of innocence and will have the right to a Hearing to posit their defense to the DEP allegations. GadFly has failed to make this point often enough in its commentary. Interestingly, when GadFly made this point...of the Forman's entitlement to the presumption of innocence before the Hearing...some criticism was leveled at GadFly. At bottom...your observation is the correct one...the presumption of innocence is something the Formans are entitled to at this juncture in time.

Again, the openness of the GadFly forum...allows for fair minded people who at first get only one side of an incident to be reminded by those on the other side, or without a dog in the fight...that there is always another perspective that should be considered...and fundamental to fairness...is the presumption of innocence.
