Subject: Re: Prince Albert: Larry, I wanted to thank you for taking on the battle to hold Steve Waszen accountable. I’m not sure I fully understand the law here. The road has been used for a long, long time so why is there not an easement there? Aren’t there people living off that road whose only public road is Prince Albert? How can the township allow tax paying citizens to have their public road taken away?
RESPONSE: The legal concept of “easement” and “adverse possession” apply between individuals, but when government is involved the government cannot take private property without compensation. And, it works the other way as well where government is involved; say Mullica owned land and individuals used a path through that land, there can be NO easement where government is involved...same property but not owned by government and indeed an easement occurs. Picture a Township owned park and you play on the field for over 20 years and now the government is going to use the park land for something else and you say NO I have a the right of “easement” because I have used the land for over 20 years...the Court says NO...so the law works both ways when a government entity is involved.
However, your point about the fact that people have lived and used Prince Albert for over 50 years as their road to their house affords them a clear legal easement. Further, THE CORRUPT MULLICA 5 AKA IDIOTS R US have a legal obligation to see to it that the people who no longer have a right of way to their house are provided with public services...should there be a fire, or need of an ambulance the Township seems to be placing itself in a position of extreme liability in its failure to address this issue
The representations that the matter is a matter to be resolved between two property owners and the Township has no interest or dog in this fight, as made by the Mullica solicitor, tim THE GIRLY MAN SHYSTER maguire at a recent Township meeting is just another indication of how the interests of Mullica’s citizens in stopping the garbage rail transfer station from coming to fruition are being sold out by the Republican Party of Mullica and the County.
