THE PERONA BROS. JUNK YARD & THE SCOFFLAW WASZEN

Today was Court in Mullica's Municipal Court and on the docket were a variety of Complaints relating to the recent dumping on the Perona property by steve THE SCOFFLAW waszen the new owner. While THE SCOFFLAW waszen was not in Court, his attorney was.

The Consent Order agreed to and formalized today calls for; 1. "Waszen acknowledges that the property's use as a junk yard or scrap recycling center as well as any and all other uses associated therewith have been abandoned." So this property will no longer be used as a junk yard.

2. All scrap metal will be...removed ...by Feb. 16, 2004
3. All scrap tires removed by Feb 16, 2004
4.. All trailers removed by March 1, 2004.
5. Demolition of all structures that are on the property by March 16, 2004
6. Property to cleared of all debris by April 16,2004
and property will be graded and grassed by then.

THE SCOFFLAW waszen further pled guilty to operating a solid waste disposal site without proper permits for 49 days (this concerning the illegal dumping of about 25 truck loads of construction debris on the adjoining Mike Perona property.) and a fine of $49,000 was assessed. This fine is reduced to $2,500 if the clean up (1 through 6) are completed by January 16, 2004...or $5,000 if it takes till Feb 1, 2004...or $10,000 if it takes until Feb 16, 2004.

The Complaints were not dismissed and should be rescheduled sometime after April 16, 2004 to allow the Court to asses the situation.

"Steven Waszen shall be responsible for addressing environmental health and safety issues that are associated with clean up activities...not limited to removal of...stored tanks and gas cylinders...asbestos materials stored in trailers or elsewhere (and) a separate agreement will be executed...(for) the repayment of sums expended through the..clean up of tires at the site before December 17th 2003."..The Court held.

At the moment this looks like a good deal for all...but given THE SCOFFLAW'S record one needs to be wary. As Earnest Hemingway noted: NEVER MISTAKE MOTION FOR ACTION.
